Company about to be struck off


Hi all

I have a client in a horrible mess. He went missing and basically hasn't paid his corportion tax liability for the last 12 months. HMRC have applied for the company to be struck off and it's going to court in a few weeks to be removed from the register.

The client want's to keep the company open but can't afford to pay the tax, although he's willing to make interim payments. He's tried phoning HMRC to offer to set up a payment plan but HMRC won't listen and say he's left it too long. He's very upset and doesn't know where to turn. He's asked me for advice but this is well outstide my comfort zone. 

Can anyone recommend a professional who could offer him some advice?

He could go and speak to a qualified accountant locally to him but dont think will be much use.  Given he cant pay the CT the accountant would probably be looking to be paid up front before doing anything and not sure there is a lot they could do in anycase.

If HMRC arent interested in a payment plan and are wanting the amount due in full and he cant pay it then there is nothing that he can do to prevent HMRC winding up the company.

I assume he wants to keep the company because of the name?  As there cant be any assets in the company or he would be able to sell these and realise some funds.  If he is just wanting to keep the company name then he could wait until the company is dissolved then reapply to acquire the name.

You mean HMRC are going to court to wind up the company?

HMRC can't get a company struck off, only Company House can do that (for not submitting annaul returns and/or accounts).

I guess you aren't a member of a professional body, as most of them (including the IAB) have insolvancy practictioners they recommend.
