VAT Returns, electronic or not


Hi
I am having a bit of a bad day and was hoping someone will be able to clarify something for me.

A client has finally brought round their paperwork for me to complete their VAT return for the quarter to April 30, 2010 which must be filed by May 31, 2010.

At the moment they are not registered to file it electronically.

They have received a letter from HMRC stating that they must file vat returns and pay electronically from April 1, 2010. It also states that for VAT periods starting on or after April 1, 2010 you must file vat returns online and pay vat due elctronically.

So I am right in thinking that they can file the quarter to April 30 on paper and then the next quarter must be filed electronically.

Their turnover must have been over a certain amount (£100,000) for the previous four quarters.

That is the thing Peasie they haven't but according to the same letter from HMRC it states that their records show that it has.

But can I still submit the quarter to April 30, on paper

I would interpret it as yes you do have to file this one online. But the experts might be able to argue a way out of it so I'll leave it to them.

I think this has been discussed before and the outcome was any quarter from april 1st onwards would have to be electronic but the quarter your on about has 2 months previous so you will be able to do it on paper, obviously the next one will be electronic.

I don't know why I was asking the date of the letter. The February letter is mentioned in the link but it still comes to how you interpret their wording. HMRC could have made things easier by saying "Return for period ending xx/xx/2010 must be filed online and paid electrnically. They are individually generated so they know which return they are talking about.

Hi Mark,

If your client hasn't been sent a paper VAT return, then I would think it would have to be filed online.  If you have a paper return, I would use it and then get them registered.

Yes they have got the paper return, which I was going to use but then started doubting myself once I had found the letter. I will get them authorised once this return is in.

Hi Mark,

you will be fine to use the paper one, but get them enrolled for online submissions from now on.

I phoned the tax office on this a couple of weeks ago.

One of my clients had a VAT return due 30 April 2010 for the period ending 31 March 2010, and this could be forwarded on paper. But the next one will have to be online as anything from period 1 April 2010 is to be online VAT return.

I think if HMRC have sent you a paper return that this would be OK.

If you get sent a paper return, you can use it. Online will only become the norm if they are sent a piece of paper telling them they have to enter the info online.

Its a strange system, as I have just completed a return 01/02 - 30/04, paper copy, but for someone else 01/03 - 31/05 its an online return, all registered for VAT at the same time, the same directors etc, work that one out!
