Australian Employee


Hi Guys,  We have an employee who is emigrating to Australia and will continue to work for us remotely.  

Does anyone know where I can find out about the income tax implications for this employee confuse preferably in basic English as the only thing I can find is in legalese no

Hi Riel, your employee can remain on the UK payroll but if they become non-UK resident under the Statutory Residence Test, they need to be paid without deduction of PAYE by using the NT code.  Your employee should also notify HMRC of their departure by sending form P85 to HMRC: https://www.gov.uk/government/publications/income-tax-leaving-the-uk-getting-your-tax-right-p85.

The other question you'll need to consider is NIC and whether the employee wants to remain in the UK social security system for a period of time after their departure, or will they join the Australian system straight away. Best to have a chat to them about this.

Isnt there also the branch issue for the employer, therefore needing to take advice in Australia themselves.

Could that be construed as giving tax advice to an employee, who is not a client, Check with PII. Or is said employee now a client?  Employee needs to take tax advice in UK and Aus too. Look up the double taxation treaties, although if your qualifications are current from your profile ensure you are able to give such advice under your licence etc.

Care you dont use the NT code too early.
