MTD - Help please x


Just come back to work after a lovely holiday & getting married in Santorini, V much holiday and wedding blues plus total mind blown moment with reading up & trying to get my head around MTD. The rain def not helping here!!

 

So I just have a few questions. One of my limited clients I recently submitted VAT return as I usually do for him on HMRC gateway, Then i panicked and thought crap MTD! I do a lot of his work through excel and HMRC submissions. Now beginning to use moneysoft for CIS & payroll but panicking I have made a mistake filing vat as usual with MTD in force.. Why are they still allowing gateway submissions if no longer allowed?

 

Also another client has been receiving MTD deadline letters. Please can I just get some information on whats the best software for MTD - I am a sage user at present. Also what else I should be doing / reading / studying to get up to speed. I have attended the HMRC webinars, read through AAT advise & magazine I just want to hear from you trusted lot in plain english please as nothing is making this simple (my mind needs simple right now & my sleep patterns are being dramatically effected with the thoughts of MTD & deadlines - AHHHHH)

 Because not everyone needs to use MTD, eg VAT reg voluntary and turnover below £85k they can still use the gateway.  In order to use MTD you have to switch your clients over to it.  No harm done if you used gateway just switch to MTD for future submissions.

If you're using sage I would export the VAT 9 box sheet (sorry dont know the proper title) to csv or excel then use something like www.vat.direct to submit it to HMRC.  That software is free and the person who programmed it, John Hemming, is a regular contributor here.

First of all, you need an ASA account, they will want your MLA details as well, so have them to hand.  Full instructions here but just holler on here if you get stuck at any stage.

Sage what? Might be able to do via that but we have no clue what version/type, so thats the first port of call. Might not need bridging.

You shouldnt have been using clients own gateway, you need to be acting as agent, so get 64-8s for future (albeit do online for MTD)

This was mandated from April, so why are you looking at this now? From an ethical standpoint, irrespective of the light touch from HMRC, this could get you in deepwater with the AAT should someone choose to complain, which they could well do given they are being made aware of the failing by them being in receipt of such letters.

Thanks to John for the reference. HMRC have been tightening up on agency. They want everyone to use an ASA account rather than use client credentials to submit returns. It is difficult for them to distinguish at a small scale between an agent handling a small number of clients and a situation where there are a number of companies possibly with common shareholders who have one team handling VAT. Hence that is not an easy thing for them to do. However, they are aiming in that direction. Also they wish to ensure that everyone registers for AML hence they require that information when signing up for an ASA.

Because I have life get in the way of studying MTD - wedding planning, babies, other business & studies (starting to calm again now into a routine - fingers crossed)

 

I didn't do it dileberately or being lazy, so the blunt, strong tone isn't needed, thanks all the same. I constantly have my head in books for the level 4 exams, plus running a house & family alongside other things has meant I havent had as much time reading up on MTD as I would of liked, hence me asking for some help from fellow book keepers!

 

I am a small fish with 5 clients at present and studying to be a hopefully slightly slightly bigger fish and grow the client base - I only currently have one VAT reg over 85k turnover client. So hopefully I will sleep a bit now without the added worry 'someone is going to complain' - doubt it, I am a joy!! haha

This is an awkward one.

I do think Caron has a point, as a mahoosive part of our day job is about compliance and ensuring we and indeed our clients abide by the current laws.  The very fact that your client has not moved to MTD, made any attempt (unless can be proved otherwise) nor indeed written to HMRC for a waiver can very easily be brought up in a compliance check by HMRC, if they do an inspection/review,  even though they are, generally speaking in this case, taking a light touch approach.

I appreciate life can get in the way, but, we in this profession have to be seen to be above such things else we could end up being penalised from one extreme for bringing the profession into disrepute and at the other extreme via fines etc for both us and our clients.  

At least you are on the case now and only have one so it wont take you too long to get it sorted.
