Strike off company and Annual Return


Hi,

My client has sent a DS01 form to strike off his limited company (he has formed this company and opened a business bank account but then found a different job and never started trading). CH has replied to confirm that the company will be dissolved after 3 months. A week after he received an Annual Return reminder. My question is shall the Annual Return be submitted in the above situation?

To be honest, if you don't what will they do? Strike it off?

The only problem is £5,000 fine you can pay if prosecuted.

Except if the company is struck off - how can they fine or procecute the company £5k? The company has to exist for it to be procecuted!

The threat is for trading companies as understandably Company House does not want companies trading if they are not submitting their annual returns.

Hi,

I got reply from CH today:

"When the company files the DS01 we do not chase for any further documents to be filed, including the annual return. "
